Your Legal Position Under the New Labour Codes

India brought its four consolidated labour codes into force with effect from 21 November 2025 — the Code on Wages 2019, the Industrial Relations Code 2020, the Code on Social Security 2020, and the Occupational Safety, Health and Working Conditions Code 2020 — replacing 29 earlier central statutes.

Three points matter to household workers.

Appointment letters are mandatory. Employers are required to issue appointment letters to workers. If you work through a platform, an agency or a housing society, ask for it in writing. A written record is what turns a verbal arrangement into an enforceable one.

Wages have a uniform definition, with excluded allowances capped at fifty per cent of total compensation — which limits the practice of keeping basic pay artificially low.

Social security now extends to gig and platform workers, which is directly relevant if you work through an app-based service rather than a single employer.

Household employment in private homes sits in a weaker enforcement zone than factory or shop employment. That does not mean you have no standing — it means written terms matter more. Agree your salary, hours, weekly off and duties over a message you can keep.

Protection Against Harassment

Under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, the definition of workplace under Section 2(o) includes a dwelling place or a house. A domestic worker is specifically covered — defined as a woman employed to do household work for remuneration, whether in cash or kind, directly or through an agency, on a temporary, permanent, part-time or full-time basis.

Because a private household has no internal complaints committee, complaints go to the Local Committee constituted at district level under Section 6 of the Act. Rule 6 permits a third party to file on behalf of a worker who cannot do so herself.

Separately, the Child Labour (Prohibition and Regulation) Amendment Act, 2016 imposes a complete prohibition on employing any child below 14 in any establishment. Insurance and Social Security You Should Have

e-Shram registration is the base layer. e-Shram is the national database of unorganised workers at eshram.gov.in, open to workers aged 16 to 59 who are not covered by EPFO, ESIC or a government-funded NPS. Domestic workers are explicitly included. You need an Aadhaar number, a mobile number linked to that Aadhaar, and a bank account with IFSC. Registration is free, and more than 31 crore workers have already registered.

Pradhan Mantri Suraksha Bima Yojana costs ₹20 a year and provides accidental death or total disability cover of ₹2 lakh, with ₹1 lakh for partial disability, for ages 18 to 70.

Pradhan Mantri Jeevan Jyoti Bima Yojana costs ₹436 a year for ₹2 lakh life cover from any cause, for ages 18 to 50.

Atal Pension Yojana provides a guaranteed monthly pension of ₹1,000 to ₹5,000 after age 60, for non-taxpayers joining between 18 and 40.

Together, the first two cost under ₹40 a month for ₹4 lakh of protection. For someone earning ₹15,000, that is the highest-return financial decision available anywhere.

Beyond government schemes, ask employers whether their health insurance or group personal accident insurance extends to household staff. Some housing societies now arrange group cover for registered domestic workers, and many employers will add you if asked — very few offer unprompted.

Most state police forces now run online domestic help verification.
